These Terms of Service ("Terms") govern your use of the thistracker.com website and the This Tracker mobile application (together, the "Service"), operated by This Tracker ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Summary: The platform is free to use and there is no subscription. You pay only for the optional credit bundles you choose to buy, and only on our website. You are responsible for having a lawful basis to track any vehicle or person you monitor with the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. If you use the Service on behalf of a business or organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" refers to that organisation.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us at [email protected] if you believe your account has been accessed without your permission.
Creating an account requires you to actively tick a checkbox confirming that you have read and accept these Terms and our Privacy Policy. Continuing to the sign-up form without doing so, including via Google or Apple sign-up, will not create an account. When you accept, we record that acceptance, together with the date, time, and the version of these Terms you accepted, against your account.
This Tracker is a fleet management platform. It receives position reports from GPS tracking hardware that you install in your vehicles or assets, and presents that data as live maps, trip history, geofence alerts, reports, and notifications.
The mobile application is a viewer and control surface for that data. It does not collect location from your phone, and it does not request phone location permissions. All position data originates from the GPS hardware you register.
GPS tracking is regulated in most jurisdictions. You are solely responsible for ensuring that your use of the Service is lawful. By using the Service you confirm that, for every vehicle, asset, or person you monitor:
You must not use the Service to track any person without a lawful basis — including covertly tracking a partner, family member, or any individual who has not consented. Doing so is a serious misuse of the Service and grounds for immediate termination, and may be a criminal offence.

Creating an account, registering GPS devices, and using the core tracking features of the Service are free of charge. There is no subscription and no recurring platform fee.
Some features consume metered credits. You buy these as one-off, pay-as-you-go bundles:

If a credit balance reaches zero, only the corresponding metered feature stops working. Your account, your devices, your position history, and live tracking remain available.
Credit bundles are purchased on our website. Prices are shown inclusive of the currency in which you will be charged, and that same currency is used throughout checkout. Payments are processed by our payment providers; we do not store your full card details.
Purchased credits do not expire. Because credits are consumed immediately on use, unused credits are refundable at our discretion within 14 days of purchase, provided the bundle is substantially unused. Credits already spent are non-refundable. Nothing in this section limits any statutory refund rights you have under the consumer law of your jurisdiction.
Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money except as set out above or as required by law.
You retain ownership of the data you put into the Service, including your device list and the position history your trackers generate. We process that data to operate the Service as described in our Privacy Policy, which forms part of these Terms.
You can permanently delete your account and personal data at any time — from the app, or via our account deletion page. Deletion is irreversible.
We work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free operation. The Service depends on things outside our control, including mobile networks, GPS satellite coverage, your tracking hardware, and third-party providers.
Important: Do not rely on the Service as your only safeguard for safety-critical, emergency, or high-value asset recovery purposes. Position data can be delayed, inaccurate, or unavailable — for example where a device loses signal, runs out of power, is obstructed, or is removed.
We may modify, suspend, or discontinue any part of the Service. Where a change materially reduces functionality you rely on, we will give reasonable notice when we can.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms — in particular section 3 (tracking without a lawful basis) or section 4 (acceptable use) — or where required by law.
Where the circumstances allow, we will give you notice and an opportunity to put the breach right first. On termination, your right to use the Service ends and your data may be deleted in line with our Privacy Policy.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that position data will be accurate, complete, or timely.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or vehicles or assets, arising out of or relating to your use of the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
You agree to indemnify and hold us harmless from any claim, loss, or demand — including reasonable legal fees — brought by a third party arising from your use of the Service, your breach of these Terms, or your tracking of any person or asset without a lawful basis.
We may update these Terms from time to time. When we make material changes, we will:
Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to a change, stop using the Service and delete your account.
These Terms are governed by the laws of the Republic of Zimbabwe, without regard to its conflict of law rules. The courts of Zimbabwe will have jurisdiction over any dispute, except that you may bring a claim in your local courts where the consumer law of your country of residence gives you that right.
